One of main problem for workers in garment industry who produce international brands is lack of control and responsibility from buyer upon working condition and worker’s rights. Instead, buyers only care about achievement of production served by employer who received order from buyer. As the result, poor quality of working condition and violation of worker’s rights happening all the time. This practice also happened to workers in PT. Uni Enlarge Industry Indonesia, member of Congress of Indonesian Unions Alliance (KASBI), who lived under uncertain situation after the last dispute in company.
PT. Uni Enlarge Industry Indonesia operating in Jakarta (Kawasan Berikat Nusantara or Nusantara Industrial Zone, Block A 07, JL. Jawa 13, Cakung Cilincing, Jakarta, Utara, Indonesia, 14140) and Semarang (Kawasan Industry Candi or Candi Industrial Area, Blok 15 No. 1. Jl. Gatot Subroto, Semarang). This garment company have more than 1500 workers with 90 percent of them are woman, consist of married women as majority. This company served the order from many popular label/brands, such as: Talbots, J Jill, Nygard, Esprit, Guess, Kellwood, Li & Fung, Liz Claiborne, Jones Apparel Group USA dan CJ Apparel Group LLC.
In line with Jakarta Pusat Court of Commerce Decision on 26 August 2009, this company stated as bankrupt and since then there should be no production activities in this company. In fact, at that time PT Uni Enlarge Industry Indonesia still in production and the workers did not know about the bankrupt decision. In addition to this legal problem, company not pay workers’ wage since June 2009 to August 2009, allowance on Eid Mubarak Day 2009 and workers insurance fee. The company owner, a Taiwan citizen,has been disappearing since that time and never give explanation to workers.
The buyers has responsibility with the problem faced by worker in PT Uni Enlarge Industry Indonesia which leave unpaid for their wages and allowances because buyers also get benefit from production and has to monitoring working condition and situation where their product was made. Buyers like Talbots, J Jill, Nygard, Esprit dan Guess, Kellwood, Li&Fung, Liz Claiborne, Jones Apparel Group USA dan CJ Apparel Group LLC has to responsible to situation where the workers leave unpaid and unfair.
Based on the information we gathered, buyers has liabilities to PT Uni Enlarge Industry Indonesia which is now under court regulation as assurance in bankruptcy process of PT Uni Enlarge Industry Indonesia to PT. Bank China Trust Indonesia with nominal as follows:
Regarding to this situation as describe above, we, Kongres Aliansi Serikat Buruh Indonesia (KASBI – Congress of Indonesian Unions Alliance) as trade union confederation demand responsibility from all buyers, such as: Talbots, J Jill, Nygard, Esprit dan Guess, Kellwood, Li&Fung, Liz Claiborne, Jones Apparel Group USA dan CJ Apparel Group LLC to:
Conclude all workers right in PT. Uni Enlarge Industry Indonesia with description: monthly wages on June to August 2009 and Allowance of Eid Mubarak day with total IDR 1,890,814,705.00.
Pay allowance or insurance fee on workers in PT. Uni Enlarge Industry Indonesia, with total IDR. 1,319,193,329.72
